Sky Map: Terms of Service & Privacy Policy

By using Sky Map, you are agreeing to the terms below. Please read them carefully.

“We”, “us” and “Penterakt” refer to Penterakt LLC, which publishes and operates Sky Map and is the party responsible for it under these terms.
“The App” refers to the Sky Map application.
“Contributors” refers to the many people who have contributed code, translations and data to the Sky Map open-source project. Sky Map remains open source and community-built; Contributors are not parties to these terms and carry no obligation or liability under them.

1. Summary

Sky Map comes with no warranties. While we can think of no conceivable way it could harm your phone or you (except perhaps giving you a neck ache from looking up at the sky), you are using it entirely at your own risk.

2. Using Sky Map

Intellectual Property: Using Sky Map does not give you ownership of any intellectual property rights over the content you access.
Content Usage: You may not use content from Sky Map unless you obtain permission from its owners (see in-app help/acknowledgments) or are otherwise permitted by law.
Branding: These terms do not grant you the right to use any branding or logos used in Sky Map.
Legal Notices: Do not remove, obscure, or alter any legal notices displayed in or along with the App.

3. Privacy Policy

How Sky Map handles data is set out in the Privacy Policy, which is part of these terms. In short, Sky Map has no accounts and does not ask for your name or contact details. The Google Play and iOS versions send usage statistics, not linked to your name or account, to Firebase Analytics (Google), and you can turn this off at any time in Settings. The F-Droid version sends none.

4. About Sky Map

License: Penterakt LLC gives you a personal, worldwide, royalty-free, non-assignable, and non-exclusive license to use Sky Map.
Open Source: Sky Map’s source code is published at github.com/sky-map-team/stardroid and you may use it in accordance with the licenses set out there. Branding and visual assets are separately licensed and are not covered by the open-source grant.
Updates & Changes: This software may update automatically. We are constantly improving Sky Map and may add or remove features, or stop supporting the app altogether, at any time.

5. Warranties and Disclaimers

We are proud of Sky Map, but we make no promises about it.

Legal Disclaimer: Other than as expressly set out in these terms or additional terms, neither Penterakt LLC nor its suppliers or distributors make any specific promises about the App. For example, we don’t make any commitments about the content within the App, its specific functions, reliability, availability, or ability to meet your needs. We provide the App “AS IS.”

Some jurisdictions provide for certain warranties, like the implied warranty of merchantability, fitness for a particular purpose, and non-infringement. To the extent permitted by law, we exclude all warranties.

6. Liability for Sky Map

To the extent permitted by law, Penterakt LLC and its suppliers/distributors will not be responsible for:

Lost profits, revenues, or data.
Financial losses.
Indirect, special, consequential, exemplary, or punitive damages.

Total Liability: To the extent permitted by law, the total liability for any claims under these terms is limited to the amount you paid us to use the App (i.e., $0.00). In all cases, Penterakt LLC will not be liable for any loss or damage caused by the App.

7. Business Uses

If you are using Sky Map on behalf of a business, that business accepts these terms. It will hold harmless and indemnify Penterakt LLC from any claim, suit, or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs, and attorneys’ fees.

8. About These Terms

Modifications: We may modify these terms to reflect changes to the law or the App. Updated terms will be shown in the App. If you do not agree to modified terms, you should discontinue use.
No Waiver: If you do not comply with these terms and we don’t take action right away, we are not giving up any rights (such as taking action in the future).
Severability: If a particular term is not enforceable, it will not affect any other terms.
